Customs Recordation in Myanmar

Protecting your Intellectual Property does not end with registration. To prevent the entry of counterfeit and pirated goods into the Myanmar market, rights holders can proactively record their IP with the Myanmar Customs Department.

This administrative mechanism serves as a primary “gatekeeper,” allowing Customs officials to identify and intercept infringing shipments at all major ports and border crossings.

Key Features of the Recordation System

  • Eligibility: Recordation is currently available for Trademarks (under Notification No. 50/2023) and Copyrights & Related Rights (under Notification No. 107/2025).
  • Prerequisite: To be eligible for Customs recordation, the IP must first be officially registered with the Intellectual Property Department (IPD) of Myanmar.
  • Validity: Once accepted, a recordation is valid for two (2) years and is renewable for successive two-year periods.
  • Proactive Interception: Recorded IP allows Customs officials to suspend suspected goods, significantly speeding up the enforcement process.

Suspension of Infringing Goods

If Customs identifies suspected counterfeit or pirated goods, they will issue a Suspension Order.

  • Notification: Both the rights holder (or their representative) and the importer are notified within 15 days.
  • Security Deposit: To maintain the suspension, the rights holder must provide a security deposit (currently set at 10,000,000 MMK or 10% of the goods’ value) to cover potential liabilities.
  • Inspection: Rights holders are granted the opportunity to inspect the suspended goods to confirm infringement, which can then lead to further legal action or destruction of the goods.
